Trademark Class

Goods used for stringing, binding, or fastening mainly comprise natural or synthetic materials and fall under Trademark Class 22. These products include tarpaulins, bags and sacks, sails, strings, tents, ropes, nets, and awnings. Because of their durability and adaptability, goods in this class are essential to several industries, including transportation, agriculture, and outdoor leisure.

What is Trademark Class 22?

Among the total 45 classes, trademark class 22 is one of the classes established under the Nice classification system, an international standard for categorising goods and services for trademark applications.

Trademark Class 22 consists of goods made of natural or synthetic materials that are utilised for stringing, binding or securing purposes. These goods include strings, tents, ropes, nets, awnings, sails, bags, sacks, tarps, etc. It mainly consists of raw fibrous materials, including jute, raw cotton, wool, and silk, which are utilised to manufacture various knitted and woven items.

This class also encompasses goods such as fibrous materials used for packing, textile fibres, and materials utilised for padding that are not made of plastics or rubber. Goods that fall under this class are crucial in various industries, such as shipping, agriculture and outdoor recreation, because of their versatility and durability.

Goods such as cords and ropes are essential for securing and lifting loads in shipping and construction. Also, awnings and tents are crucial in camping and other outdoor activities that offer shelter and protection from different elements. Additionally, this class also includes sailcloths that are utilised in the boating industry and transportation of goods.

However, this class doesn’t include some goods identical to those that fall within this class, such as bags or canvas items that fall under other trademark classes because of their intended utilisation or material composition. To guarantee appropriate protection and classification, companies must carefully consider whether their items belong under Class 22, which reflects the class’s concentration on materials and products needed for commercial, industrial, and recreational purposes. This evaluation is done before submitting a trademark application.

What Goods Come Under Trademark Class 22?

The primary contents of Trademark Class 22 include raw fibrous textile materials, rope, cushions, padding, stuffing materials, canvas, and other materials used to make sails. The following items are listed as belonging to this trademark class:

  • Cords and twines are paper, plastic, or synthetic or natural textile fibres.
  • Hammocks, rope ladders, and commercial fishing nets
  • Car coverings that are not installed
  • Certain bags and sacks that aren’t generally categorised according to their use or function, such as mail bags, body bags, or bags made of mesh for laundering clothing
  • Putting together cloth bags
  • Raw textile fibres derived from animals, such as cocoons, jute, animal hair, untreated or chemically treated wool, and raw silk

Furthermore, it’s essential to remember that the USPTO invented the idea of related classes. USPTO, or the United States Patent and Trademark Office, is the organisation’s full name. According to the USPTO, applications for all connected classes must be submitted in addition to those for registration of trademarks under Trademark Class 22.

The Coordinated Classes of Trademark Class 22 are as follows:

  • Carpets are categorised under class 24,
  • Marketing and business services are under class 35,

Who is Eligible to File a Class 22 Trademark Application?

Multiple classifications are allocated to trademark applications in India based on the Nice Classification. There are presently 45 distinct trademark classifications in India. Class 22 includes products utilised in rope production with sails and padding, including stuffing materials and raw fibre textile materials.

Any company or individual engaged in the production or distribution of the items specified in Class 22 may submit an application for trademark registration in this class. The following are the procedures for acquiring a trademark in India: The applicant has to file a trademark application with the Trademark Registry of the applicable jurisdiction.

The application and the list of products and services that need to be registered must include a precise and readable depiction of the mark. The examiner examines the application to make sure it satisfies all substantive and procedural criteria. If the mark is appropriate for registration, it will be published in the Trade Marks Journal.

Any third party may oppose the mark’s registration within sixty days of publication. If no opposition is filed or is dismissed in the applicant’s favour, the mark is registered, and an authorisation to register is issued. After the filing date, the registration is valid for ten years and is renewed.

What is the Registration Process for Trademark Class 22?

To acquire a registration of your business or company under trademark class 22, you will have to follow the below-given steps:

  1. The initial stage of trademark registration in Trademark Class 22 is choosing a unique mark that is not indistinguishable from an already-existing mark.
  2. After deciding which mark to register, you need to look up trademarks to ensure the mark doesn’t conflict with any already registered marks.
  3. After you receive your mark, you must prepare a petition for registration and ensure no other marks clash with it.
  4. The intended mark you wish to use, information about the services or products it would represent, and the legal name of the individual or company that holds the mark must all be included in this application.

Famous Examples of Trademark Class 22

Here are some famous examples of trademark class 22:

  • Black Diamond: Climbing ropes, stuff sacks, and tents
  • Coleman: Tents and tarps
  • Tent Mart: Tarpaulins, ceilings, mandaps, pandals, tents, and other tent-related products.
  • Packing string, nets, tarpaulins, raw fibrous cloth, and White Mountain

To Wrap Up

Trademark Class 22, which focuses on products connected to fabrics and materials that are flexible and utilised in numerous sectors, is quite crucial in trademark registration. Products of all kinds, including fabrics, sacks, bags, nets, and tents, are included in this class.

Businesses may protect their textile and flexible material-related products by establishing their registered trademarks within Class 22, which grants them sole ownership of their brand identification within this particular category. For legal security and adherence to trademark rules and regulations, trademarks must be correctly classified under Class 22, particularly for businesses operating in sectors where fabrics and elastic substances are vital.

Frequently Asked Question

  1. What is a Class 22 Trademark?

Class 22 of trademarks covers textile and flexible material goods and is one of the 45 classes established by the Nice Classification system for trademark registration. It includes ropes, nets, tents, tarpaulins, awnings made of textile products or synthetic materials, sails, sacks for transporting and storing materials in bulk, and padding and stuffing materials.

  2. What kinds of products fall under Trademark Class 22?

Items in Trademark Class 22 include bags, sacks, textile articles, and flexible materials like nets and tents. Sails and sacks are commonly employed for bulk transportation and storage of materials and stuffing materials. Tents, nets, ropes, and tarps are typically constructed from textile products or synthetic materials.

  3. Why does Trademark Class 22 Matter to Companies?

For companies that deal with fabrics and flexible resources, Class 22 is essential since it offers unique opportunities for trademark registration, guaranteeing exclusive ownership of their trademarks under this product area.

  4. What Trademark Class are bags?

Travel products not covered by other trademark classes, saddlery, and leather imitations make up most of trademark class 18. Products composed of leather or synthetic leather are also included. In particular, walking sticks, harnesses, purses, bags, umbrellas, and animal skins are included in the lesson.

  5. How is rope classified?

Since the rope is a textile, the materials used to make its fibres are also frequently found in commercial and industrial settings, including, but not limited to, flooring, apparel, and medical equipment. Rope materials are generally categorised as synthetic or natural.

  6. Is it possible to trademark a name twice which is the same?

Trademark law would allow the two companies to use the same name if they are unconnected and unlikely to cause misunderstanding. Stated differently, registering an identical title in several trademark classes does not provide access to a claim of infringement.

  7. May I use a single trademark to represent various products?

By submitting a single patent application, a trademark owner can register it in many classes. All classes are visible to a trademark entrepreneur inside a multiclass trademark registration application (Form TM-A).
